Privacy policy

Dataflex International B.V. and all of its subsidiaries (Dataflex Benelux B.V., Dataflex Deutschland GmbH and Dataflex France Sarl, hereinafter referred to as ‘Dataflex’ handle the personal data of third parties with care. In doing so, Dataflex complies with the legal requirements of the General Data Protection Regulation (AVG). This document is for information on this.

1. What is personal data?

Any information about an identified or identifiable natural person is personal data. This means that information is directly about someone or can be traced back to someone.

2. What personal data does Dataflex process?

Dataflex only processes the data required for business operations. Other information is not requested and, should it reach Dataflex anyway, deleted. Examples of data required for business are:

contact details: name, address, place of residence, telephone number, e-mail address
gender
customer number(s)
financial data: bank account information, quotations, orders, invoices
data on the use of products and/or services
data from surveys and reports

3. Processing: bases and legitimate interests

The processing of personal data takes place on the following bases from Article 6 of the AVG:

consent;
performance of a contract;
legal obligation;
performance of a task of public interest;
legitimate interest of Dataflex or third party.

Justified interests include marketing, advertising, security, (crime) prevention, IT management, research and analysis of own products or services, corporate governance, legal affairs, internal management.

4. Purposes of processing personal data

Dataflex processes personal data for the purposes listed below:

Establishing and maintaining customer relationships including maintaining a direct relationship between the responsible party, dealers, service partners and related financial service providers, including for commercial purposes.
Handling orders (including invoicing), processing in financial records and logistical handling.
Providing customer service including service around buying services and products, fulfilling warranty obligations and product recalls for our own services and those of dealers or service partners, handling complaints and requests.
Conducting market research to improve our operations, services and products.
Keeping customer relations informed of price changes, range changes or other commercial information. There is always the option to unsubscribe or change your e-mail address.
Improving the content of Dataflex communication by tailoring it to personal preferences.
To (further) develop and improve new and existing products and services.
Measuring customer satisfaction, providing management information and determining overall business strategy.
Complying with legal obligations, settling disputes and enforcing our rights and agreements.

5. Sharing with third parties

Dataflex shares personal data with third parties in the following cases and for corresponding reasons, among others:

with affiliated financial service providers;
with authorised dealers or service partners from Dataflex's distribution network;
upon legal obligation or authority to provide personal data to third parties;
upon suspicion of a violation of the rights of third parties, of criminal offences or of abuse, Dataflex may provide personal data to third parties who have a legitimate interest in doing so or to bodies serving the public interest. These may include enforcement authorities such as the Public Prosecution Service or supervisory authorities;
Dataflex may also share data with other business units within the Dataflex holding company for the performance of agreements, or because of justified business interests, such as keeping a central administration or customer service, and analysing services;
with parties who assist Dataflex in its services and are not processors (think accountants and (legal) advisors);
for business economic purposes (such as the sale of business activities or shares or a reorganisation.

6. Data retention periods

Personal data is retained in accordance with Dataflex's internal data retention policy and/or for as long as (i) the customer relationship lasts, (ii) Dataflex is legally obliged to retain data, or (iii) Dataflex believes it has good grounds to retain data, e.g. for warranty claims.

7. Mapping website traffic

When visiting Dataflex websites, cookies may be used for the purpose of providing visitors with a better, faster and more secure and personalised customer experience. Cookies can be refused (For more details, see: https://www.dataflex-int.com/en/cookies).

8. Rights

Everyone has the right to know what personal data Dataflex has recorded about him/her and to whom this personal data has been provided.

The other rights of persons whose data Dataflex processes are:

the right to withdraw consent to process (certain) personal data, insofar as this does not conflict with other (legal) obligations of Dataflex;
the right to file a complaint with the Personal Data Authority;
the right to rectify/correct (or have rectified) personal data;
the right to removal of personal data, insofar as this does not conflict with other (legal) obligations of Dataflex;
the right to restriction of the processing in question;
the right to data portability;
the absolute right to object to direct marketing;
the right to object to processing carried out due to the legitimate interests of Dataflex or a third party (depending on personal circumstances).

9. Data security and protection

Dataflex applies appropriate security measures to prevent abuse, loss, unauthorised access, unwanted disclosure and unauthorised modification as far as possible. Dataflex has taken both technical and organisational measures to secure personal data. These security measures are periodically reviewed based on threats
